Brattle Experts Contribute a Chapter on Quantifying Damages in Extractive Sector Disputes to the 6th Edition of The Guide to Damages in International Arbitration

A Brattle-authored chapter has been published in the sixth edition of The Guide to Damages in International Arbitration, which was recently published by Global Arbitration Review.
Principals Darrell Chodorow and Dr. Florin Dorobantu and Associate Dr. Fernando Bañez explored different valuation approaches in disputes in the natural resource extractive sectors – e.g., oil and gas and mining. This sector is often characterized by large projects that are of strategic importance to involved parties – including governments – and disputes within can give rise to substantial claims. In the chapter, the authors provide an overview of the types of investor-state and commercial disputes that can arise, and detail two well-known approaches to valuation – the income and market approaches – that can be used to assess project value and damages across different commodities and project stages.
